What is a fixed charge receivership?
A fixed charge receivership, also known as an LPA (Law of Property Act) receivership, is a legal remedy that allows a lender to take control of a property when a borrower defaults on their loan obligations. The process originates from Section 101 of the Law of Property Act 1925, which gives a lender the power to appoint a Receiver to act on its behalf.
In modern practice, most appointments are made under both the lender's fixed charge (mortgage) and the powers afforded by the Act. The Receiver acts as agent for the borrower but has a primary duty of care to the lender, to act properly and to achieve the best possible outcome.
A fixed charge receiver can take possession of the property, collect rents, arrange insurance, instruct agents and manage the disposal process, all without requiring a court order, making it one of the most effective enforcement remedies available to secured lenders.

We are fully aware of the FCA's requirements for the fair treatment of customers, including vulnerable borrowers, and work with our secured lender clients to ensure this is reflected in every appointment. Our team is formally trained in identifying and supporting vulnerable customers, and all concerns are flagged directly to the instructing lender.

Pre-appointment site review & risk assessment
Prior to appointment, we undertake a contingent site review to assist lenders in making informed decisions. This includes a site visit to confirm occupancy, identify potential issues (insurance compliance, contamination, livestock) and review legal and title documentation. Our pre-appointment report includes photographs, property commentary and valuation advice.
Pre-appointment valuation advice
Comprehensive valuation advice by reviewing any previous lending valuations and providing a current opinion of value. We highlight issues that may impact the saleability and value of the asset. Our management team are RICS Registered Valuers with experience across residential, agricultural, commercial and development sectors, predominantly in distressed situations.
Possession, security & asset management
We handle all matters relating to taking possession of the property, including attendance at eviction. Once unoccupied, we ensure properties are secure and compliant with insurance requirements, including lock changes, drain downs, SIA Licensed guards, fixed CCTV systems, clearance and repair works to enhance value and saleability.
Sales & marketing advice
We focus on achieving best value whilst ensuring the sales process runs efficiently. Our team liaises with appropriate local agents to arrange three separate market appraisals and auction guides, reporting back with a concise disposal recommendation covering method of sale, strategy and the most suitable agent or auctioneer.
Sales progression
We act as a single point of contact throughout, ensuring regular weekly updates and close liaison with agents, auctioneers and solicitors. Our team of experienced negotiators ensures best value is achieved while keeping time costs to a minimum so interest does not continue to accrue unnecessarily.
Property management & rent collection
Our experienced property management team manages multiple portfolios, operating with a RICS Client Account. We handle service charge budgets, commercial lease renegotiations, legal compliance and refurbishment works to enhance value and saleability, including identifying development options to add value where there is a potential shortfall.

We undertook a pre-appointment site visit to confirm occupation and the presence of livestock, then secured the site with supervised access for the debtor to remove belongings. We instructed an agricultural specialist, coordinated removal of horses and cattle, and provided a valuation and marketing strategy recommendation.
